This page describes the general methods used to process the personal data of Site users and the use of cookies; please refer to individual sections where Site users can find specific information and requests for consent (for individual processing). Volta, 49 – 47014 Meldola (FC), is committed to protecting your personal information; this document aims to help you understand what information we may collect and how we use it.
A) Processing methods
This document has been drafted pursuant to Article 13 of EU Regulation 2016/679 (hereinafter: « Regulation ») so that you are aware of our privacy policy. We describe the general methods used to process the personal data of Site users and the use of cookies, and show how your personal information is managed when you use our website (hereinafter « Site »). The information and data provided by you or otherwise acquired when using Emicon services will be processed in compliance with the provisions of the Regulation and with confidentiality obligations taken on by Emicon. In accordance with the provisions of the Regulation, processing carried out by Emicon will be based on the principles of lawfulness, fairness, transparency, limitation of purposes and retention, and data minimisation, accuracy, integrity and confidentiality. The Data Controller for processing carried out through the Site is Emicon, as defined above. Emicon is pleased to provide any information you might require concerning the processing of your personal data.
B) Type of data
We inform you that when browsing the Site Emicon will process your personal data (Article 4(1) of the Regulation), hereinafter referred to as « Personal Data ». The Personal Data processed through the Site will be:
B1. Browsing data
During normal operations, IT systems and software procedures used to operate the Site will acquire personal data, transferred implicitly when using Internet communication protocols. This information is not collected to be associated with any identified data subjects, however due to its nature it might lead to the identification of users through processing and association with data held by third parties. This category of data includes IP addresses or domain names of computers used by users connecting to the Site, URI (Uniform Resource Identifiers) of requested resources, time of request, method used to submit the request to the server, file size obtained in response, numerical code indicating the status of the server response (successful, error, etc.) and other parameters regarding the user’s operating system and IT environment. These data are used solely to obtain anonymous statistical information on the use of the Site, to check that the Site is running correctly (see the section on cookies below), and to identify anomalies and/or abuses, and are deleted immediately after processing. These data might be used by the relevant authorities to ascertain responsibility in the event of cybercrimes committed against the Site.
B2. Data provided voluntarily by the data subject
Apart from what is specified for browsing data, the user is free to provide personal data in request forms on the Site (e.g. requests for information, contacts, etc.). Failure to provide such data may make it impossible for Emicon to provide the requested service. In these cases, only the information needed to provide the desired service will be requested.
C) Purpose of data processing and legal basis
The processing of your personal data, with your specific consent where necessary, has the following purposes:To provide the Site’s Services; the legal basis for processing is the execution of pre-contractual measures adopted on request (art. 6(1)(b) of the Regulation), since data must be processed in order to provide the Service. The submission of Personal Data for these ends is optional, but failure to provide such data may result in the Site not being able to provide its Services.
D) Recipients of personal data
Your personal data may be shared, for the above-mentioned purposes, with:
– persons authorized by Emicon to process Personal Data needed to carry out the activities strictly related to the provision of the Services, who are committed to maintaining confidentiality or have an adequate legal obligation of confidentiality (e.g. employees and system administrators);
– any third parties involved in the management of the Site who typically act as Data Processors;
– persons, entities or authorities who require the communication of your personal data in accordance with law provisions or by order of the authorities.
E) Your privacy rights pursuant to Articles 15 et seq. of the Regulation
In accordance with Article 15 et seq. of the Regulation, you are entitled to access your personal data at any time, seek changes or their deletion or not consent to their processing; you also have the right to request limited processing in the cases set forth in Article 18 of the Regulation, and to obtain your data, in the cases provided for by Article 20 of the Regulation, in a structured, commonly used format that can be read on an automatic device.You are always entitled to file a complaint with the competent supervisory authority (Italian Data Protection Authority – Garante per la Protezione dei Dati Personali) in accordance with Article 77 of the Regulation if you think that the processing of your personal data is in breach of applicable laws and regulations.

Definitions, characteristics and application of legislation
Cookies are small text files that the websites visited by the user send and record on your terminal device (computers or mobile devices such as smartphones and tablets), which are then re-transmitted to the same sites on the next visit.A website uses cookies to remember the user’s actions and preferences (such as login data, chosen language, font size, other display settings, etc.) so that they do not have to be given again when the user revisits the website or browses from one page to another. Cookies are used for computer authentication, session monitoring and to store information about users who log on to a website, and may also contain a unique identification code that enables them to track user browsing within the Site for statistical or advertising purposes.
Classification of cookies
When browsing a Site, in addition to cookies stored directly by the site visited (so-called « first-party cookies »), the user may also receive cookies on his computer from websites or web servers other than the one being visited (so-called « third-party cookies »).
Some operations could not be performed without the use of cookies, which in some cases are therefore technically necessary for the website to operate.
There are various types of cookies, depending on their traits and functions; these may remain on the user’s computer for different amounts of time. « session cookies », also referred to as « browsing cookies », are automatically deleted when the browser is closed; so-called « permanent cookies » remain on the user’s device until a predetermined expiry date.
Then there are so-called « analytics » or « statistics » cookies, used for the purpose of evaluating the effectiveness of a service provided, designing websites or measuring site « traffic », that is the number of visitors, possibly broken down by geographic area, time slot of the connection or other characteristics.
According to legislation in force in Italy, the user’s express consent is not always required for cookies to be used. So-called “technical cookies” are used for the sole purpose of transmitting a communication over an electronic communications network, or are necessary to provide a service expressly requested by the user. These are cookies that are essential for the operation of the Site or necessary to perform activities requested by the user, in the absence of which some operations could not be carried out or would be more complex and/or less secure.
Technical cookies, which do not require express consent for their use, according to the Italian Data Protection Authority (see Cookie guidelines and other tracking tools dated 10 June 2021 and subsequent clarifications, hereinafter « Guidelines ») also include:
analytics cookies if their use makes it impossible to directly identify (or « single out ») the data subject, thus preventing the use of analytics cookies, which may be direct and unique identifiers. Their structure moreover must provide for the possibility of referring them not to one but to several devices, in order to create reasonable uncertainty as to the online identity of the recipient (usually through the masking of portions of the IP address within the cookie itself, as indicated in the Guidelines). Finally, to be identified as technical, analytics cookies should be limited to the production of aggregate statistics only, to be used in relation to a single site/mobile application, so as not to allow the tracking of the person that uses different applications or browses different websites;
